Man Who Attacked Gay Couple Avoids Jail Time, Tries to Hug Victims in Court

A North Carolina man who admitted to calling a Florida gay couple "faggots" and attempted to attack them with his scooter avoided jail time, the Miami Herald reports.

Florida Keys Judge Wayne Miller did not sentence Brandon Ray Davis, 30, with any jail time for the February incident. At a hearing this week, Davis received four years probation, 75 hours of community service - a portion of which must be LGBTQ-related - and banned from drinking alcohol for two years. He will also undergo a substance abuse and a psychological evaluation and take anger management classes.

Davis admitted to calling Kevin Paul Taylor and his partner Kevin Seymour "faggots," and yelling, You're in Trump country now!" before smashing his scooter into Seymour's back bike tire. Miller said the injuries suffered, which included a flattened bike tire and a chain knocked off, weren't severe enough to warrant a day in jail for Davis. Assistant State Attorney Colleen Dunne asked Davis be sentenced to 60 days in jail, according to the newspaper.

Davis was originally arrested for felony aggravated battery and was allowed to plead guilty to a lesser charge. At the Wednesday hearing, Davis' fiancee and two family friends testified that his actions on the day of the incident were out of character. Davis also had 30 letters of support, including one from an openly gay friend, the Miami Herald reports.

At one point during the hearing, Davis turned toward the couple he assaulted earlier this year and walked towards them in the court's center and reportedly tried to hug them, according to the Miami Herald.

"My heart goes out to you guys, every bit of it," Davis said to Taylor and Seymour, who were sitting in the front row behind the prosecutor's table. "I'm asking you to come put your arms around me, take my hand."

The newspaper writes, "the two men were silent."

The couple said they were disappointed Davis did not receive jail time.

"At the end of the day he assaulted us," Taylor told the Miami Herald. "At least a few days in jail."

As previously reported, Davis was drunk on his scooter when he used gay slurs and taunts towards the men, who were riding their bikes. Davis yelled to them, "You guys are a couple of fags" and "I bet you faggots voted for that bitch Hillary [Clinton.]"

The couple left the scene but Davis followed them, eventually ramming his scooter into the back of Seymour's bike. When the couple told Davis they were calling the police, he said, "If you call the cops I will cut that faggot body up" and told them he was a correctional officer. Davis, however, said he was a landscaper in court, according to the newspaper.
